These Terms of Service (“Terms”) govern your use of the website auraframmes.it.com (the “Site”) and the purchase of any digital photo frames (“Products”) from Auraframmes (“we,” “us,” or “our”). By accessing the Site or placing an order, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to make a purchase. By placing an order, you represent that all information you provide is accurate and complete, and that you are the authorized user of the payment method.
2. Product Descriptions
We make every effort to display product colors, finishes, and screen properties as accurately as possible. Due to variations in monitor settings, actual product appearance may differ slightly from what you see on your screen. All specifications and packaging are subject to change without prior notice, but any such changes will not lower the quality of the item you receive.
3. Pricing and Order Acceptance
All prices on the Site are listed in U.S. dollars. The total you see at checkout is the full amount you will be charged; there are no additional fees, surcharges, or recurring subscriptions added to a product purchase. We reserve the right to correct any pricing errors that may appear on the Site. If an error is discovered after you have submitted an order, we will notify you and give you the option to proceed at the corrected price or cancel the order without charge. We also reserve the right to refuse or cancel any order for reasons including stock unavailability, a suspected fraudulent transaction, or an issue with your payment method.
4. Payment Terms
We accept payment via Visa, MasterCard, and PayPal. Your card or PayPal account is authorized when the order is placed and charged when the order is packed and ready for shipment. By submitting your payment details, you authorize us to charge the total order amount.
5. Shipping and Delivery
Shipping and delivery are governed by our Shipping Policy, which is incorporated into these Terms. We ship to all 50 U.S. states using standard service. Title and risk of loss for the Product pass to you upon our delivery to the carrier. Delivery dates are estimates and we are not liable for delays that are the direct result of carrier disruptions or force majeure events.
6. Returns and Refunds
All returns and refunds are handled according to our Return & Refund Policy. You have 30 calendar days from delivery to initiate a return for remorse or defective reasons. The steps to obtain a return label and the timeline for refunds are fully described in that policy. There are no restocking fees for any qualifying return.
7. Intellectual Property
All content on the Site—including text, graphics, logos, images, product videos, and the Auraframmes brand name—is our exclusive property or used with permission by us. You may not reproduce, distribute, or use any content from the Site for commercial purposes without our prior written permission.
8. Limitation of Liability
To the fullest extent permitted by law, Auraframmes shall not be liable for any indirect, incidental, or consequential damages arising from the use of our Site or the purchase of our Products, including loss of data stored on a frame. Our total liability for any claim related to a Product you purchased is limited to the amount you paid for that specific Product. This limitation does not exclude or limit any liability that cannot be lawfully limited by applicable law.
9. Indemnification
You agree to indemnify and hold harmless Auraframmes and its employees from any claim or demand made by a third party due to your violation of these Terms or your use of the Site.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising from these Terms shall first be addressed by contacting us directly at info@auraframmes.it.com to seek an amicable resolution. If a resolution cannot be reached, the dispute shall be resolved exclusively in the state or federal courts located in Volusia County, Florida.
11. Changes to the Terms
We may modify these Terms at any time. Changes will be effective immediately upon posting to the Site. It is your responsibility to review the Terms periodically. Continuing to use the Site after changes are posted constitutes your acceptance of the revised Terms.
